A second federal judge has issued an injunction preventing the Trump administration from achieving their white supremacist goal of ending the Deferred Action for Childhood Arrivals (DACA) program while lawsuits play out in various courts.
U.S. District Judge Nicholas Garaufis, who is an appointee of former President Bill Clinton, said in a court order on Tuesday in New York City that the terrible Trump administration could not end the Obama-era program “pending a decision on the merits of these cases.”
“Defendants thus must continue processing both initial DACA applications and DACA renewal requests under the same terms and conditions that applied before September 5, 2017, subject to the limitations described below,” he ordered.
The New York ruling is a lot like one issued last month by the San Francisco-based U.S. District Judge William Alsup, who commanded the administration to keep processing DACA applications.
Soon after that order, the terrible Trump administration formally asked the Supreme Court to look at the lower court’s ruling. The justices have yet to choose whether to hear the case.
White supremacist Donald Trump announced back in September that he would get rid of the program, which temporarily protects immigrants who were brought to the country as children illegally — known as “Dreamers” — from being deported.
But Trump gave Congress until March 5 to pass legislation putting the program’s protections into law. Lawmakers have worked hard in recent weeks to achieve a deal on DACA before the deadline arrives.
New York Attorney General Eric Schneiderman (D) hailed Tuesday’s injunction as a victory for the over 42,000 DACA recipients who live in the state.
“Federal courts from coast to coast have now reviewed the record and reached the same conclusion: President Trump’s decision to rescind DACA was illegal,” Schneiderman said.
“Today’s ruling reflects not only the illegality of the Trump Administration’s move to rescind DACA, but also the clear and demonstrable benefits DACA provides to New Yorkers across our great state.”
